OVERVIEW
Welcome to Freedom Fabrications. The terms "we", "us" and "our" refer to Freedom Fabrications doing business as FRDM Fabs. We operate this store and website, including all related information, content, features, tools, products and services (the "Services"). Freedom Fabrications is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced here (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms carefully. They include important information about your legal rights, including warranty disclaimers, limitations of liability, and your responsibilities regarding product fitment, installation, and safe use of our products.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and that you have given us consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, including browsing our store or purchasing products, you may be asked to provide information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
We build fabricated steel truck accessories, including tool boxes, fuel transfer tanks, fuel and tool combination units, underbody boxes, mounting brackets, and related equipment.
We have made every effort to represent our products accurately. However, product colors and appearance may differ from how they appear on your screen depending on your device and its settings.
Because our products are fabricated and finished by hand, minor variation is normal and is not a defect. This includes weld bead appearance and finish, powder coat color, gloss and texture variation between production batches, and dimensional tolerance of plus or minus 1/4 inch on fabricated components.
We do not warrant that the appearance or quality of any product will meet your subjective expectations or match exactly what is depicted in our online store.
All product descriptions, specifications, and dimensions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and to limit quantities offered to any person, geographic region, or jurisdiction on a case-by-case basis.
SECTION 3 - FITMENT AND VEHICLE COMPATIBILITY
You are responsible for confirming that a product fits your vehicle and your application before you order.
Published dimensions, bed widths, frame clearances, and compatibility notes are provided as a guide. Vehicle configurations vary by year, trim, bed length, aftermarket modifications, prior body work, and manufacturer running changes. We cannot guarantee fitment on any specific vehicle.
If you are unsure, contact us at sales@frdmfabs.com before purchasing and we will help you measure and confirm.
Returns due to fitment errors are subject to our Refund Policy, including return freight and restocking charges.
SECTION 4 - INSTALLATION, LOAD LIMITS, AND SAFE USE
Professional installation. Our products are heavy steel assemblies that mount to vehicles. We strongly recommend professional installation by a qualified shop. You are solely responsible for proper installation, including correct fastener selection, torque, mounting point selection, and any drilling, welding, or modification to your vehicle.
Vehicle damage. We are not responsible for damage to your vehicle arising from installation, removal, or use of our products, including damage to the bed, frame, wiring, fuel or brake lines, paint, or finish.
Payload and weight ratings. Our products add substantial weight to your vehicle, and that weight increases significantly when loaded with tools, equipment, or fuel. You are solely responsible for ensuring that the combined weight of the product, its contents, your cargo, and your passengers does not exceed your vehicle's payload capacity, gross vehicle weight rating, gross axle weight ratings, or tire load ratings. Exceeding these ratings is dangerous and may void your vehicle manufacturer's warranty.
Load securement. You are responsible for properly securing all contents and for ensuring that installed products do not obstruct lighting, mirrors, license plates, or your field of view.
Fuel transfer tanks and fuel handling.
Our fuel transfer tanks and fuel and tool combination units are designed and constructed for the transport and transfer of [DIESEL FUEL ONLY? / SPECIFY FUELS]. They are not designed, tested, or approved for gasoline, ethanol blends, aviation fuel, or any other Class 1 or Class 3 flammable liquid, and must not be used for those products. They are not designed for potable water, agricultural chemicals, or any material other than the fuels listed above.
These units are transfer tanks intended to carry fuel as cargo. They are not auxiliary fuel tanks and must not be plumbed into your vehicle's fuel system. [WE CAN FIX OR REMOVE IF WE DO OFFER AUXILIARY TANKS]
Our tanks have capacities in gallons as stated on the product and are [NON-BULK PACKAGING?]
Transporting fuel is regulated by the U.S. Department of Transportation and by state and local authorities. You are solely responsible for determining and complying with all applicable requirements for your intended use, which may include registration, marking, labeling, placarding, quantity limits, securement, and driver qualification requirements, and which differ depending on whether your use is personal or commercial. Requirements applicable to commercial motor vehicles and to hazardous materials transported in commerce are more extensive than those applicable to personal use.
You are also responsible for proper mounting and securement, for proper grounding and bonding during transfer, for safe fueling practices including turning off the engine and prohibiting smoking and open flame in the transfer area, for preventing spills, leaks, overfilling, and contamination, and for inspecting the tank, pump, hose, and fittings for damage or wear before each use.
Do not modify, weld, cut, drill, or repair a tank. Do not use a tank that has been dented, punctured, corroded, or involved in a collision. Do not pressurize a tank. Do not fill beyond the marked capacity.
Assumption of risk. You assume all risk arising from installation, loading, and use of our products. We are not liable for injury, property damage, cargo loss, fuel loss, regulatory fines, or citations resulting from improper installation, overloading, misuse, modification, or failure to comply with applicable law.
SECTION 5 - ORDERS
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason at our discretion. Your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting. We may be unable to accommodate cancellation requests after an order is accepted, and cancellation of custom and made to order products is governed by Section 6 below.
If we do not accept, change, or cancel an order, we will attempt to notify you using the email address, billing address, or phone number provided at the time the order was placed.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
Resale. Products purchased through our online store are for your own use, whether personal, business, fleet, or commercial. They are not for resale. If you want to carry our products, contact sales@frdmfabs.com about our dealer program.
Export. You are responsible for compliance with all applicable export and import laws if you ship or carry our products outside the United States, including duties, customs charges, and any local regulatory approvals.
SECTION 6 - CUSTOM AND MADE TO ORDER PRODUCTS
Custom builds, non-standard sizes, special powder coat colors, and special order configurations are produced specifically for you and are handled differently from stock inventory.
Specifications. You are responsible for the accuracy of the specifications, dimensions, and drawings you provide. We build to the approved spec. Once you approve a spec in writing, changes may result in additional charges or a new lead time.
Quotes. Quotes for custom work are valid for 14 days unless otherwise stated. We reserve the right to re-quote if steel or component costs change materially before the order is accepted.
Deposits. Custom orders may require a deposit of 50% before production begins.
Cancellation. Custom and made to order products may be cancelled before production begins. Once material has been cut or fabrication has started, the order cannot be cancelled and deposits are non-refundable.
Lead times. Lead times for custom work are estimates, not guarantees, and are subject to material availability and shop capacity.
SECTION 7 - PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as set out in your order confirmation email. Unless expressly stated, posted prices do not include taxes, freight, handling, accessorial charges, customs, or import charges.
Prices posted online may differ from prices offered at our facility, at trade shows, or through dealers. From time to time we may offer promotions governed by terms separate from these Terms. If there is a conflict, the promotion terms govern.
You agree to provide current, complete, and accurate purchase, payment, and account information, and to promptly update it so that we can complete your transactions and contact you.
You represent and warrant that the payment information you provide is true, correct, and complete; that you are authorized to use the payment method for the purchase; that charges you incur will be honored by your card issuer or bank; and that you will pay all charges at the posted prices, including freight, handling, and applicable taxes.
Tax exemption. If you are purchasing tax exempt, a valid resale or exemption certificate must be on file with us before the order is placed. We cannot retroactively refund sales tax on completed orders.
SECTION 8 - SHIPPING, FREIGHT, AND DELIVERY
Most of our products ship by LTL freight.
Title and risk of loss. Shipments are FOB origin. Title and risk of loss pass to you when we transfer the product to the carrier.
Delivery estimates. All delivery times are estimates only and are not guaranteed. We are not liable for shipping or delivery delays, including delays caused by carriers, weather, customs processing, or events outside our control.
Freight charges and accessorials. Freight quotes are based on the delivery information you provide. Additional carrier charges, including liftgate service, residential delivery, limited access locations, delivery appointments, storage, redelivery after a missed appointment, and address corrections, are your responsibility and may be billed to you after the fact if they were not included in the original quote.
Delivery requirements. Curbside freight delivery does not include unloading. You are responsible for having adequate personnel or equipment, such as a forklift, loading dock, or liftgate service ordered in advance, to receive the shipment.
Inspection and freight claims. You must inspect the shipment before signing the delivery receipt and note any damage or shortage on the delivery receipt or bill of lading before the driver leaves. Signing a clean delivery receipt significantly limits what can be recovered from the carrier. Damage, shortage, and concealed damage reporting is governed by our Refund Policy.
Refused shipments. Shipments refused without cause are subject to return freight, redelivery charges, and restocking fees.
SECTION 9 - WARRANTY
Our products are covered by our limited product warranty, which sets out the exclusive warranty terms, coverage period, exclusions, and remedies.
Except as expressly stated in that limited warranty, all products are provided subject to the disclaimers in Section 21 below.
SECTION 10 - DEALERS AND WHOLESALE
Purchases made under a dealer, distributor, or wholesale agreement are governed by the terms of that agreement. Where those terms conflict with these Terms, the dealer agreement governs for that transaction.
SECTION 11 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, displays, images, graphics, product photography, product reviews, video, audio, drawings, and designs, and the selection and arrangement of them, are owned by Freedom Fabrications, its affiliates, or its licensors, and are protected by U.S. and foreign patent, copyright, and other intellectual property laws.
These Terms permit you to use the Services for your personal or internal business use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the Services without our prior written consent. Authorized dealers may use approved product images and marketing materials only as permitted under their dealer agreement or with our written approval.
Except as expressly provided here, nothing in these Terms grants a license or other rights under any patent, trademark, copyright, or other intellectual property of Freedom Fabrications, Shopify, or any third party. Unauthorized use of the Services may violate federal and state intellectual property laws. All rights not expressly granted are reserved.
Freedom Fabrications' names, logos, product and service names, designs, and slogans are trademarks of Freedom Fabrications or its affiliates or licensors. You must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names and marks appearing on the Services belong to their respective owners.
SECTION 12 - OPTIONAL TOOLS
You may be provided with access to third party tools as part of the Services, which we do not monitor and over which we have no control or input.
You acknowledge and agree that we provide access to such tools as is and as available without warranties, representations, or conditions of any kind and without endorsement. We have no liability arising from or relating to your use of optional third party tools.
Any use of these tools is entirely at your own risk and discretion, and you should ensure you are familiar with and approve of the terms on which they are provided by the relevant third party provider.
We may offer new features through the Services in the future. Those features are also part of the Services and subject to these Terms.
SECTION 13 - THIRD PARTY LINKS
The Services may contain materials and links to websites provided or operated by third parties, including embedded third party functionality. We are not responsible for examining or evaluating the content or accuracy of third party materials or websites. If you leave the Services to access them, you do so at your own risk.
We are not liable for any harm or damages related to your access of third party websites, or your purchase or use of any products, services, resources, or content on them. Review the third party's policies and practices before you engage in any transaction. Complaints, claims, concerns, or questions regarding third party products and services should be directed to that third party.
SECTION 14 - RELATIONSHIP WITH SHOPIFY
Freedom Fabrications is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Freedom Fabrications. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Freedom Fabrications, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Freedom Fabrications.
SECTION 15 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit will be transmitted to and shared with Shopify and third parties that may be located in countries other than where you reside, in order to provide services to you. See our Privacy Policy for details.
SECTION 16 - FEEDBACK AND REVIEWS
If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, photos, plans, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for any purpose, including commercial use. For example, we may use customer photos of installed products in our marketing.
You represent and warrant that you own or have all necessary rights to the Feedback; that you have disclosed any compensation or incentives received in connection with submitting it; and that it complies with these Terms. We have no obligation to keep Feedback confidential, to pay for it, or to respond to it.
We may, but are not obligated to, monitor, edit, or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable, or that violates any party's intellectual property rights or these Terms.
You agree that your Feedback will not violate any third party right, will not be libelous or otherwise unlawful, abusive, or obscene, and will not contain any virus or malware. You may not use a false email address, impersonate another person, or mislead us or third parties as to the origin of any Feedback. You are solely responsible for your Feedback and its accuracy. We assume no liability for Feedback posted by you or any third party.
SECTION 17 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information in the Services containing typographical errors, inaccuracies, or omissions relating to product descriptions, specifications, dimensions, weights, pricing, promotions, offers, freight charges, transit times, or availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice, including after you have submitted your order.
SECTION 18 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, state, provincial or local law, rule, regulation, or ordinance; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms; (g) to transmit or procure the sending of any advertising or promotional material, including junk mail, chain letters, or spam; (h) to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or that may harm Freedom Fabrications, Shopify, or users of the Services, or expose them to liability.
You also agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, duplicate, copy, extract, sell, resell, or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the Services; (e) use any robot, spider, scraper, data gathering or extraction tool, or automated means to access the Services for the purpose of copying, republishing, or commercially exploiting our content, pricing, or product data; or (f) interfere with, bypass, or circumvent our security or authorization features, robot exclusion headers, or other access controls.
We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.
SECTION 19 - AGENTS
19.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can be executed on behalf of or using a person's device without direct supervision.
19.2 No Agent may access, use, or interact with the Services unless it identifies itself and operates in strict accordance with Section 19.4 at all times. In addition, no Agent may access, use, or interact with the Services if we have requested that it refrain from doing so.
19.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with the Services.
19.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the Agent's name by including "Agent/[agent name]" in the user agent string; (ii) not conceal or obfuscate that access is from an Agent, including by mimicking human behavior and interaction patterns or by completing or circumventing CAPTCHAs or other measures intended to distinguish computer use from human use; (iii) respond truthfully to any question or prompt seeking to determine whether interactions are coming from a human or a computer; and (iv) not circumvent or avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.
SECTION 20 - TERMINATION
We may terminate this agreement or your access to the Services, or any part of them, in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
The following sections continue to apply after any termination: Installation, Load Limits and Safe Use; Intellectual Property; Feedback and Reviews; Termination; Disclaimer of Warranties; Limitation of Liability; Indemnification; Severability; Waiver and Entire Agreement; Assignment; Governing Law; Privacy Policy; and any other provisions that by their nature should survive.
SECTION 21 - DISCLAIMER OF WARRANTIES
The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information, including published dimensions, weights, capacities, and fitment guidance. Any reliance you place on such information is strictly at your own risk. We disclaim all liability arising from any reliance placed on such materials by you or anyone else.
EXCEPT AS EXPRESSLY STATED IN OUR LIMITED PRODUCT WARRANTY, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.
SECTION 22 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL FREEDOM FABRICATIONS, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, DOWNTIME, VEHICLE DAMAGE, CARGO OR FUEL LOSS, REGULATORY FINES OR CITATIONS, TOWING OR RECOVERY COSTS, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT OR PRODUCT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
SECTION 23 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Freedom Fabrications, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party arising out of (1) your breach of these Terms or the documents they incorporate by reference; (2) your violation of any law or the rights of a third party; (3) your access to and use of the Services; or (4) the installation, modification, loading, or use of any product you purchase from us, including any claim arising from improper installation, overloading, or non-compliance with applicable transportation or safety regulations.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent, not to be unreasonably withheld. You will cooperate in the defense of indemnified claims, including by providing relevant documents.
SECTION 24 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 25 - WAIVER; ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, including any prior versions of the Terms of Service.
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
SECTION 26 - ASSIGNMENT
You may not delegate, transfer or assign this agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.
SECTION 27 - GOVERNING LAW AND VENUE
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. You and Freedom Fabrications consent to exclusive venue and personal jurisdiction in the state and federal courts located in Gaines County, Texas.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

You can review the most current version of the Terms of Service at any time on this page.
We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice.
